1. Agreement to Terms

By accessing or using CarScanAI, you agree to be bound by these Terms of Service. If you do not agree, do not use our service.

2. Service Description

CarScanAI provides AI-powered vehicle inspection reports based on photos you upload. Our service is a screening tool designed to help you evaluate vehicles remotely. It is not a replacement for a professional in-person mechanic inspection.

IMPORTANT: CarScanAI is an AI-assisted screening tool only. It is NOT a professional vehicle inspection, appraisal, or certification service. Our AI analysis is based solely on user-uploaded photos and has inherent limitations. You should never rely solely on our reports when making vehicle purchase decisions.

3. Accuracy Disclaimer

Our AI analyzes visible issues in photos, including damage, wear, paint defects, and other observable problems. However:

• We cannot detect hidden mechanical issues, test drive performance, or problems not visible in photos
• Accuracy depends on photo quality, lighting, and coverage of the vehicle
• AI analysis may miss issues or provide false positives in some cases
• We do not guarantee that all issues will be detected

Always get a professional pre-purchase inspection before buying any vehicle.

4. Payment and Pricing

CarScanAI operates on a pay-per-report basis:

• Quick Check: $4.99 per report
• Full Inspection: $14.99 per report
• Bundles: Prepaid multi-report packages available at discounted rates

Payment is processed securely through LemonSqueezy. All prices are in USD unless otherwise specified.

5. Refund Policy

Due to the immediate, digital nature of our AI analysis service, refund eligibility depends on the circumstances:

Eligible for a full refund:

• Report failed to generate due to a technical error on our end
• Payment was processed but no report was delivered within 10 minutes
• Duplicate charge for the same report

Not eligible for a refund:

• Report was successfully generated and delivered (the digital service has been fully rendered)
• Dissatisfaction with AI findings — our analysis is an AI-assisted screening tool with inherent limitations, as disclosed before purchase
• Poor photo quality resulting in limited analysis — photo quality warnings are shown before submission

All refund requests must be submitted within 7 days of purchase. To request a refund, email support@carscanai.net with your order ID and reason. Approved refunds are processed within 5-10 business days to the original payment method.

6. Dispute Resolution

Any disputes arising from or relating to these Terms or the use of CarScanAI shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association.

You agree that any arbitration will be conducted on an individual basis and not as a class action, collective action, or representative action.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

The arbitration shall take place in the jurisdiction where CarScanAI operates.

7. Indemnification

You agree to indemnify, defend, and hold harmless CarScanAI and its operators from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising from your use of the service, your violation of these Terms, or your reliance on any information provided by the service.

8. User Responsibilities

You agree to:

• Provide accurate information and photos
• Use the service only for lawful purposes
• Not upload copyrighted or inappropriate content
• Not attempt to reverse-engineer or misuse our AI models
• Not share your account credentials with others
• Understand that our reports are screening tools, not professional inspections

9. Limitation of Liability

To the maximum extent permitted by law, CarScanAI and its operators shall not be liable for:

• Any vehicle defects not detected by our AI analysis
• Financial losses resulting from vehicle purchases based on our reports
• Damages arising from inaccurate or incomplete analysis
• Service interruptions, data loss, or technical failures

Our total liability is limited to the amount you paid for the specific report in question.

IN NO EVENT SHALL CARSCANAI'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM. THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10. Intellectual Property

All CarScanAI branding, logos, software, and AI models are proprietary. You retain ownership of your uploaded photos, but grant us a license to process them for report generation and service improvement.

11. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the service.

12. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via email or site notice. Continued use of the service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State in which CarScanAI's principal operator resides. Any disputes will be resolved through binding arbitration as described in Section 6.
